Councilmembers will consider a proposed ordinance to ban price-fixing through use of automated rent-setting software. They will also hear the Salary Ordinance for FY 2026 which establishes compensation schedules of all officers and employees of the City of San Diego.

Item 331 – 2024 Annual Report on Internal Financial Control
This Annual Report on Internal Control is issued pursuant to City of San Diego Municipal Code, adopted by the City Council in October 2004 to achieve a high standard of quality in and efficacy of the City of San Diego’s financial reporting and disclosure practices.

The objective of a system of internal controls over financial reporting is to provide reasonable assurance that the financial information produced is reliable and that it reflects the City’s transactions and events for the reporting period.

 
Item 332 – Prohibition of Anti-Competitive Automated Rent Price-Fixing Ordinance

AI-driven price-fixing software is used across San Diego to suggest the highest rental pricing that a rental home can yield.

The Department of Justice, California Attorney General Rob Bonta, and many Attorneys General across the United States have alleged in numerous complaints that this kind of software is a modern-day price-fixing service that directly and indirectly inflates rent prices, harming millions of Americans.

Councilmember Sean Elo-Rivera proposes to protect San Diegans from automated rent price-fixing by banning the sale, license, and use of automated rent-setting software that advises or recommends rental rates or occupancy levels.

This item would amend the San Diego Municipal Code to adopt the proposed Prohibition of Anti-Competitive Automated Rent Price-Fixing Ordinance.

 

Item 333 – Salary Ordinance for Fiscal Year 2026

This action approves the Salary Ordinance being presented by the Mayor to establish a schedule of compensation for officers and employees of the City of San Diego for Fiscal Year 2026.

The Salary Ordinance establishes compensation schedules of all officers and employees of the City of San Diego for Fiscal Year 2026 whether they are represented by one of the City’s six recognized employee organizations or are unrepresented.

San Diego Charter section 290 requires that the Salary Ordinance be proposed by the Mayor for introduction to the City Council no later than April 15 each year, in a form consistent with any existing Memoranda of Understanding between the City and its recognized employee organizations, or otherwise in conformance with procedures governing labor relations that are binding on the City.

 

Item 334 – Approval of the City of San Diego’s Updated Sewer System Management Plan (SSMP)

This action seeks City Council approval of the City of San Diego’s Updated Sewer System Management Plan (SSMP). The State Water Resource Control Board’s Statewide Sanitary Sewer Systems General Order No. 2022- 0103-DWQ, requires the City to maintain an SSMP with the goal of providing a plan and schedule to:

  1. Properly manage, operate, and maintain all parts of the City’s sanitary sewer system
  2. Reduce and prevent sanitary sewer spills
  3. Contain and mitigate spills that do occur

The General Order requires the City to update its SSMP every six years, present the SSMP to the City Council for approval, and upload and certify the approved updated plan. The General Order also requires the City continuously document changes to the SSMP in a change log during the time in between SSMP updates.
