Three committee meetings fill a busy week at City Council.  Public Safety and Livable Neighborhoods Committee will consider regulating the sale of flavored electronic cigarettes, while the Economic Development and Intergovernmental Relations Committee will hear the proposed Sidewalk Vending Ordinance.  Land Use and Housing will look at the sale of a nearly 2-acre parcel to the Cal-State Board of Trustees on behalf of SDSU.

Item 1 - Ordinance amending Chapter 3, Article 3, Division 46 of the San Diego Municipal Code by amending section 33.4618, relating to pedicabs – In September of 2021, the State of California passed Senate Bill 814 and it was approved by Governor Gavin Newsom, which took effect January 1, 2022. SB 814 expanded the Vehicle Code definition of a pedicab to include electric bicycles. This amendment allows a “traditional pedicab,” as defined in the Municipal Code to operate with a pedal assist device. This Ordinance amends the Municipal Code to reflect the change in state law.

Item 2 - SAAFE Act: Stop Adolescent Addiction to Flavored E-Cigarettes Act to Regulate the Sale of Flavored Electronic Cigarettes in the City of San Diego – For decades, the tobacco industry has marketed a wide variety of highly addictive nicotine products and specifically marketed those products to children, and other vulnerable populations. This ordinance will help stop the rising rates of adolescent nicotine addiction by prohibiting the sale of certain flavored tobacco products.


 


Item 3 - Approve the allocation of $3,522,776 in Coronavirus Aid, Relief, and Economic Security (CARES) Act Emergency Solutions Grant (ESG-CV2) for the operation of the Bridge Shelters and amend the City’s FY2020 Annual Action Plan - On October 13, 2020, the San Diego City Council unanimously approved the allocation of $22,796,116 in Coronavirus Aid, Relief, and Economic Security (CARES) Act Emergency Solutions Grant to support eligible activities.  At that time, a balance of $3,552,776 in in grant funds remained unobligated.  Staff in the Economic Development Department proposes to allocate this remaining unobligated balance to the City’s operation of the Bridge Shelters

VendingItem 1 - Repeal of Pushcarts in the Public Right-of-Way and Business Regulations for Sidewalk Vending – This item would amend the City’s Municipal Code and Local Coastal Program to remove the pushcart regulations within the public right-of-way to comply with Senate Bill 946.  It would also adopt an ordinance to regulate the time, place, and manner during which an individual may participate in sidewalk vending including the use of vending equipment such as non-motorized conveyances.

Land Use and Housing Committee Meeting – February 10, 2022 – 1 p.m.

Item 1 - Lease at 9444 Balboa Avenue, San Diego, CA 92123, between Balboa Building Owner LLC and the City of San Diego


 


Item 2 - Declare 2.041 acres of City-owned real property on San Diego Mission Road, San Diego, CA “exempt surplus land” pursuant to California Government Code section 54221(f)(1)(D-E) and authorize the sale of the property to The Board of Trustees of the California State University, the State of California acting it its higher education capacity on behalf of San Diego State University – The Property was appraised by the City’s Principal Appraiser at $240,000. The Property is no longer needed for the City’s purposes, except for the operation of sewer facilities beneath a portion of the Property. Through the Grant Deed conveying the Property to CSU, the City will reserve a sewer easement and access easement for all existing and future replacement sewer facilities. As such, Council is being asked to consider declaring the Property exempt surplus land and authorizing the sale to CSU.


 


HousingItem 3 – Affordable Housing Preservation Update - At the request of Councilmember Vivian Moreno, Chair of the Land Use and Housing Committee, the San Diego Housing Commission will provide an informational update about affordable housing preservation in the City of San Diego, including the creation of the Preservation Collaborative Stakeholder Group.  Staff were directed to gather additional information and data and commission a comprehensive study to enhance the understanding of the City’s entire affordable housing stock, including naturally occurring affordable housing.
