Councilmembers will hear an item to reconsider the All People’s Church project which the Council voted not to approve in January of 2024. Subsequently, All People’s Church filed a lawsuit alleging that the denial violated Federal Law. Councilmembers will also consider an ordinance repealing San Diego Municipal Code section 56.27 for Disorderly Conduct.

Item S500 – Sharon Spivak Day
This item celebrates the public servant who has served as Executive Director of the Ethics Commission and as a Deputy City Attorney.

Item 330 – Ordinance Repealing San Diego Municipal Code section 56.27 for Disorderly Conduct
The San Diego Parks and Recreation Department recommends repealing section 56.27 of the San Diego Municipal Code, prohibiting disorderly or offensive conduct in public places.
San Diego’s disorderly conduct ordinance, Municipal Code section 56.27, is the subject of a current legal challenge in Dorsett vs. City of San Diego, 24-cv-1172-BTM-SBC. On September 23, 2024, the Court issued a preliminary injunction prohibiting enforcement of Municipal Code section 56.27. Accordingly, the Department recommends repeal of this section to avoid future legal challenges.

Item 310 – Request for Motion for Reconsideration of All Peoples Church Project
On January 9, 2024, City Council considered All Peoples Church’s application to construct a church/sanctuary building and a two-level parking garage and surface parking areas on a 5.99-acre site of undeveloped property located in the Navajo Community Plan Area in the Del Cerro neighborhood of the City of San Diego.
The City Council voted not to approve the Project. On March 25, 2024, All Peoples Church filed an action in United States District Court alleging that the denial violated federal law.
This item would suspend the Rules of Council and reconsider the project. The City Attorney’s Office recommends the approval of the requested actions.
Item 331 – Project 636444 - All Peoples Church
The action includes the approval of an amendment to the General Plan and Navajo Community Plan, a Site Development Permit, Planned Development Permit, and a Tentative Map including a re-vestment of access rights and Easement Vacations to allow for development of a new 900-seat church and parking structure on a 5.99-acre site on the east side of College Avenue, north of Interstate 8, and south of Del Cerro Boulevard in the Navajo Community Plan area.
