Tuesday's City Council meeting features a vote on the proposed legal settlement which includes the purchase of 101 Ash and Civic Center Plaza Buildings. Councilmembers will also consider an updated Climate Action Plan and an update to a downtown property.

Consent Agenda
The consent agenda contains seven items including an appointment to the Mobility Board Committee. There’s also a resolution to adopt a Conflict of Interest Code for the Sustainability and Mobility Department.

Item 30 – Beverly Jensen Day honors a teacher at Fleur de Lis preschool after 49 years of service to San Diego children from teaching assistant to Senior Director.
Item S500 - Scripps Ranch Fire Safe Council Day recognizes the group which has been dedicated to informing the public on fire safety and disaster preparedness.
Item S501 – Health Science High and Middle College Fire Tech Academy Day celebrates the great work of the Academy and Captain Nick Swift introducing public service career opportunities to young adults.
Item S502 – Orned Gabriel Day honors a martial arts instructor and self-defense trainer for his career of competition and teaching, as well as his dedicated service the community in feeding those in need.
Item S503 – Jorge Hernandez Day recognizes an instructor at the Lincoln High School Fire Technology Program who has made it his mission to improve diversity and inclusion in the fire service.
Discussion Agenda
Item 331 – 2022 Climate Action Plan – Net Zero by 2035 - The 2022 Climate Action Plan (CAP) sets a goal of achieving net zero greenhouse gas (GHG) emissions by 2035 with updated strategies, measures and actions. This update centers climate equity through robust community engagement and pushes for bold action to mitigate the effects of climate change beyond the previously adopted 2015 CAP.
Item 334 – Climate Action Plan Update Package Municipal Code, Land Development Manual, and Local Coastal Program Amendments (CAP Consistency Regulations) - This item, the CAP Update Package, is a package of amendments to the San Diego Municipal Code, Land Development Manual and Local Coastal Program that implement aspects of the CAP Update.
Item 330 - Proposed Settlement Agreement Involving Acquisition of the 101 Ash Street and Civic Center Plaza Properties - Presented for City Council consideration is a proposed settlement agreement negotiated among the following parties: (a) the City of San Diego; (b) Cisterra Partners, LLC and its affiliates, as the owner of the 101 Ash Street and Civic Center Plaza properties; and (c) CGA Capital and its affiliates, as the lender for Cisterra’s earlier acquisition of the Properties. The settlement proposal stems from extensive mediation sessions managed by retired Magistrate Judge Jan Adler and is memorialized in a proposed Settlement Agreement and Mutual Release and explained in the City Attorney’s accompanying report. Item 332 - La Jolla Farms Outfall Repair - Project No. 687244 – This item would approve all action items necessary to replace an existing storm drain pipeline, replace an existing inlet, install a new cleanout, cutoff walls, concrete energy dissipater, and restore the disturbed slopes. The 0.3- acre site is located along La Jolla Farms Road between Black Gold Road and Greentree Lane within the Residential Single-Family Zone, and Coastal Overlay Zone of the La Jolla Community Plan and Local Coastal Program.
Item 333 - Development Agreement for Bosa Development California II, Inc. Site at the Northeast Corner of Pacific Highway and Broadway - Approval of a Development Agreement for the approximately 1.4-acre property at the northeast corner of Pacific Highway and Broadway owned by Bosa Development California II, Inc. A previous agreement approved in 2012 and amended in 2016 outlined special development regulations applicable to three properties owned by Bosa, including the subject property; however, while the other properties have been developed, the subject property remains undeveloped. The 2012 agreement would be rescinded as part of this action, but the proposed Development Agreement retains the essential provisions and the remaining extraordinary benefits of the 2012 DA, as amended, for the subject property while establishing a new expiration date of September 2032.
